Kenkel, O'Brien Obtain Favorable Decision for Client in Appellate Court
On February 7, 2024, Dickinson Bradshaw insurance defense litigators Benjamin J. Kenkel and Sean O’Brien obtained a favorable decision for their client in Menard, Inc. v. Farm Bureau Property & Casualty Insurance Company, reversing a decision by the district court. Following oral argument, the United States Court of Appeals for the 8th Circuit agreed with Mr. Kenkel and Mr. O’Brien that their client was entitled to summary judgment and did not owe liability coverage to Menards pursuant to an explicit coverage exclusion in a motor vehicle insurance policy.
